Terms of Use

Last updated: October 29, 2026

Who we are and what these Terms cover

Singing Pumpkins by DittoDub turns songs into videos of three singing jack-o'-lantern faces that you can project onto pumpkins. It is provided by DittoDub, Inc., a Delaware corporation ("DittoDub," "we," "us," or "our"). These Terms cover singingpumpkins.com, its online editor, and our free Mac app, subject to the open-source licence described below.

By accepting these Terms or using Singing Pumpkins, you agree to them. If you act for an organization, you must have authority to bind it. If you do not agree, do not use the website or online editor. Your rights under the Mac app's open-source licence are preserved.

Your DittoDub account remains subject to DittoDub's Terms of Service. These Singing Pumpkins Terms control any conflict about Singing Pumpkins, including its content-processing licence, private uploads, seasonal access, and pricing. Our Privacy Policy explains how we handle personal information, subject to the specific limits on Singing Pumpkins content use, sharing, and deletion stated here. The broader content-use and AI-training permissions in the DittoDub account Terms do not expand the limited licence you give us here.

These Terms include individual arbitration and limits on liability. Nothing in them removes consumer rights or remedies that the law does not allow you to waive.

Eligibility and accounts

You must be at least 13 years old. If you are under the age of majority where you live, you may use the service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Certain paid plans, business accounts, or sensitive features may require you to be 18 or older. You must not use the service where doing so is unlawful or if U.S. law prohibits us from doing business with you.

The online editor requires a DittoDub account. Keep your account information accurate and your credentials secure. You are responsible for activity through your account, subject to applicable law. Tell us promptly if you suspect unauthorized access.

Before adding a song online, you must acknowledge these Terms using the checkbox provided. We record your account, the time, the Terms version, and your IP address as evidence of acceptance. We handle these records under our Privacy Policy.

Your songs and your rights

Only use songs you own the relevant rights to or have permission to use for everything you ask Singing Pumpkins to do and everything you do with the result. You are solely responsible for the files, links, lyrics, and other material you submit and for your use of the finished videos.

Buying a recording, paying for a music-streaming subscription, or finding a song on YouTube does not by itself give you permission to download, copy, process, synchronize it with video, share it, or perform it publicly. You may need permission for both the recording and the underlying music and lyrics. A personal or noncommercial use is not automatically permitted. Agreeing to use a song “fairly” does not make it fair use under copyright law; we do not decide whether a legal exception applies to your use.

Each time you upload a file or submit a link, you promise (represent and warrant) that you have all necessary rights, licences, and consents for us and our processors to handle the content as described here. You also confirm that your instructions and use comply with applicable law, platform rules, and others' intellectual property, privacy, and publicity rights. We may ask for evidence of permission.

When you paste a YouTube link, you specifically ask us to fetch that video's audio on your behalf and confirm that you have permission for that retrieval and subsequent processing and use. Public availability is not permission. Your authorization does not override YouTube's rules or give either of us rights that a rights holder has not granted.

We do not grant music licences or clear songs for you. Your acceptance of these Terms does not obtain permission from rights holders or prevent them from bringing claims against you or us. Sharing a finished video online may lead to a copyright claim, muting, blocking, removal, or a claim to its revenue by a rights holder. You remain responsible even if processing succeeds or the song has already been learned by our service.

Acceptable use

You must not:

These restrictions do not reduce permissions granted under the Mac app's open-source licence.

How processing works and the licence you give us

You keep your rights in your content. Using Singing Pumpkins does not transfer ownership of your songs to us or give you ownership of anyone else's music, lyrics, recordings, or other material.

For the online editor, you give DittoDub and its service providers a non-exclusive, worldwide, royalty-free licence to retrieve content at your request, host, copy, store, separate vocals, transcribe, analyze, adapt, synchronize with animation, and transmit it only as needed to provide the service, create and deliver your results, provide support, secure the service, handle complaints, and comply with law. This includes the limited shared processing of YouTube songs described below. It does not authorize us to publish your uploaded files or use them to train general-purpose AI models.

Vocal separation runs on DittoDub's own GPU servers. For YouTube links, words come from the video's captions when available or from AssemblyAI transcription. Uploaded audio may also be sent to AssemblyAI for transcription. Files are stored using Amazon Web Services (S3). The finished video is drawn and encoded in your own browser. Processing may produce mistakes in lyrics, timing, or animation. Review the result before using it.

The licence lasts only as long as needed for those purposes, including permitted retention and the shared YouTube data described below. It never gives us rights you do not have. As between you and DittoDub, you retain your rights in your contributions to the finished video; third-party material and our underlying software remain subject to their existing rights.

Shared processing of YouTube songs

We may learn a YouTube song once and reuse its timing and lyrics when other users submit the same video. This shared learned data is not a sharing of your uploaded files. Uploaded audio and its processing results remain private to your account: we do not share them with other users or match your uploads to other users' songs. DittoDub and its service providers may access and process them for the limited purposes described above.

Submitting a YouTube link authorizes this limited reuse of the resulting timing and lyrics, to the extent you have the necessary rights. Every user must still have permission to use the song. A cached result is not evidence that a song is cleared or licensed. We do not guarantee that shared data will be available, accurate, kept for any particular period, or reused for a later request. We may remove it or process a song again.

Deleting a song from your account does not necessarily remove shared timing and lyrics associated with that YouTube video. Rights holders can request removal through our copyright and takedown policy.

Storage, retention, and deletion

When you delete a song, we delete its files from our servers and AWS S3, normally within minutes. Shared YouTube timing and lyrics are handled as described above. We may delete songs, uploads, and processing results after the season ends. We are not an archive and do not promise to restore deleted content or carry it into the next season. Download your finished videos before the online editor closes.

Limited records may be retained where needed for legal obligations, security, billing, disputes, or proof of acceptance, as explained in our Privacy Policy. The normal deletion time above applies to our servers and S3; it is not a promise that a transcription provider deletes every copy within minutes. Provider-held data is subject to the applicable processing agreements, retention terms, and legal requirements.

The Mac app runs on your own Mac. It does not send your songs to DittoDub. You control its local files and backups. The online editor's seasonal storage and deletion rules do not delete files on your Mac.

Halloween season and availability

The online editor launches on October 29, 2026. This season ends at the end of November 30, 2026, U.S. Pacific time: access closes at midnight starting December 1. In future seasons, it closes at the end of November 30, U.S. Pacific time, and returns the next Halloween season. We will announce each season's opening date; we have not promised an exact date for next year.

You are paying for access while the online editor is open, not for twelve months of continuous access. It is closed outside the Halloween season, even while your annual subscription remains in its billing period. The season applies to free songs, Season Pass buyers, and users with access through a paid DittoDub plan. The free Mac app is not subject to the online editor's seasonal closure.

We intend to return each Halloween season, but cannot guarantee future availability, uninterrupted access, compatibility with every device, or continued availability of a particular song or feature. We may change, suspend, or discontinue the service for operational, security, legal, or business reasons, subject to your mandatory legal rights. If we decide not to offer a future season, we will stop renewals for that season; any payments already taken remain subject to applicable refund rights.

Plans, song limits, and the DittoDub perk

The free tier includes one successfully processed song in total per account and per client IP address, with sign-in required. It accepts YouTube links only, and the full source song and processed audio must each be no longer than six minutes; a start time or shortened preview does not make a longer song eligible. The free allowance does not renew each season. People sharing an IP address (for example, on a home, school, or workplace network) share that IP allowance. Deleting a song or account, making another account, or retrying a successful song does not restore it.

We reserve the free allowance while a song is being learned. A recorded processing failure releases the reservation so you can add a song again. An interrupted job retains its reservation and can resume the same project. Once a song is ready, its free use remains recorded even if the song is later deleted. To enforce this limit and reduce abuse, we retain the account identifier, a keyed fingerprint of the client IP address (not the raw IP in the free-use ledger), the project reference, and the reservation or usage time independently of song deletion. IP checks reduce repeat use but cannot prevent every attempt to evade the limit, including use of a different address. We handle these records under our Privacy Policy.

A standalone Season Pass provides up to five paid-access songs per account per season. An eligible paid DittoDub plan includes up to ten songs per account per season, including when you also have a Season Pass. Both are in addition to the separate lifetime free allowance. Paid access supports YouTube links and private uploads, with songs up to twelve minutes, and all-night shows. Switching between paid access methods does not create a second seasonal allowance. A song counts once it is ready. Deleting it does not restore a slot, and adding it again does not undo its previous count. Songs that fail to process do not count. The paid allowance resets each season, not when a subscription renews.

Access is included at no extra charge with any active paid DittoDub plan. This perk ends when that paid plan ends. Making additional paid-access songs then requires an active Season Pass; any unused free allowance remains subject to its account, IP, source, and duration limits. A Season Pass does not include a paid DittoDub plan.

Season Pass payments, renewal, and cancellation

The Season Pass costs US$13 per year, plus applicable taxes disclosed at checkout. It is an automatically renewing annual subscription processed by Stripe, not a one-time purchase. By purchasing, you authorize the recurring charge shown at checkout until you cancel. The checkout will show your renewal timing. It renews one year after the day you buy it, unless you cancel first. Access requires a current paid billing period and an open editor. Your purchase or renewal does not change the season dates or reset your five-song seasonal allowance. It does not provide access during the closed months.

Cancel anytime from your account page before the next renewal to stop that charge. Cancellation stops future renewals; it does not reverse a charge already made. You may continue using any remaining allowance during an open season within your already-paid billing period. Cancellation does not extend the season or make the editor available while it is closed. Closing the editor, deleting a song, or simply stopping use does not cancel the subscription.

We will give any legally required notice of price or renewal changes and obtain any consent required by law. Starting a paid DittoDub plan does not cancel a Season Pass you already bought. If you no longer need it, cancel it from your account page.

Refunds

Consistent with DittoDub's refund policy, fees are non-refundable and non-creditable once paid, except as required by law. We do not provide refunds, credits, or prorated refunds for partially used billing periods, consumed usage, cancellations after a billing period begins, unused songs, or unused time in a subscription term. In particular, we do not give partial refunds for the scheduled closed months: seasonal access is what the annual price buys.

Nothing here limits non-waivable consumer rights, including applicable withdrawal rights or remedies for a service we fail to provide as required by law. Contact contact@dittodub.com about a refund or statutory cancellation request. Acceptance of these Terms alone does not waive any statutory withdrawal right.

We do not undertake to screen every song, monitor every use, or verify users' permissions. We may review content and investigate suspected violations, and will act where required by law. Successful processing or a decision not to remove material is not our approval of it.

See our Copyright and takedowns page for notices, counter-notices, and our repeat-infringer policy. We may remove or disable allegedly infringing material, including shared learned data, and terminate repeat infringers in appropriate circumstances.

We may suspend or terminate online access or remove content if we reasonably believe you have violated these Terms, failed to pay, created a security or legal risk, or if a lawful request requires it. We may also stop providing the online service as described above. Mandatory notice and consumer remedies still apply. Termination does not revoke rights already granted under the Mac app's open-source licence.

You may stop using the service at any time, but must cancel a subscription to stop its renewal. Provisions that by their nature need to continue, including accrued payment obligations, permitted retention, liability limits, indemnity, and dispute terms, survive termination.

Third-party services

Singing Pumpkins depends on third parties, including YouTube for linked content, AssemblyAI for transcription, AWS for storage, and Stripe for payments. Their services may change or become unavailable. Their applicable terms and privacy policies govern your use of their services; our handling of your information is described in our Privacy Policy. You must comply with applicable YouTube and Google terms and policies.

Singing Pumpkins and DittoDub are not affiliated with, sponsored by, or endorsed by YouTube or Google. Access to third-party content does not imply permission from its owner.

Previously released Mac app

The Mac app was previously released under the MIT licence. It is no longer offered for download on this website. Existing copies run locally, and your songs are not sent to DittoDub. No Season Pass is needed to use those copies.

The app's MIT licence governs permission to use, copy, modify, and distribute its covered software, including its warranty disclaimer. That licence controls over any conflicting provision of these Terms about the licensed software. Dependencies may have their own licences. The software licence does not license songs or other third-party content.

Disclaimers

To the fullest extent permitted by law, Singing Pumpkins is provided “as is” and “as available.” We disclaim express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and results. We do not promise error-free lyrics, synchronization, uninterrupted access, or that any video will avoid a copyright claim. You are responsible for reviewing results and keeping copies you need.

These disclaimers do not affect warranties or consumer rights that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, DittoDub and its affiliates, licensors, service providers, officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, goodwill, data, business opportunities, or business interruption arising from the service or these Terms, even if advised that these losses were possible.

Their total combined liability for all claims arising from the service or these Terms will not exceed the greater of:

Nothing excludes or limits liability that cannot lawfully be excluded or limited, including fraud, willful misconduct, or non-waivable statutory rights.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless DittoDub and its affiliates, licensors, service providers, officers, directors, employees, and agents against third-party claims, losses, liabilities, and reasonable legal costs arising from your content, your use of the service or results, your breach of these Terms, your violation of law or another person's rights, or your fraud, negligence, or willful misconduct. This includes claims that processing content at your direction infringes someone else's rights.

We will give you prompt notice of a claim for which we seek indemnity, although delayed notice relieves your obligations only to the extent it materially harms your defense. We may take control of the defense of a covered claim, and you agree to cooperate. You may not settle a claim in a way that imposes an obligation on us or admits fault on our behalf without our written consent. This provision does not require you to cover losses caused by our own breach of these Terms or unlawful conduct, or impose obligations that applicable consumer law prohibits.

Governing law and disputes

These Terms and disputes about them or Singing Pumpkins are governed by Delaware law, without regard to conflict-of-law rules. Mandatory protections under applicable law still apply.

Before starting arbitration or litigation, you and DittoDub agree to give the other written notice of the dispute and try in good faith to resolve it through discussion for at least 30 days. Send notices to our contact address below.

Except for the exceptions below, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, including applicable consumer rules. A court with jurisdiction may enter judgment on the award. Arbitration generally replaces a court trial for covered disputes.

Either party may still:

To the fullest extent permitted by law, disputes must be individual. Neither party may participate as a plaintiff or class member in a class, collective, consolidated, representative, mass, or private attorney general proceeding.

For disputes properly brought in court or not subject to arbitration, state or federal courts in Delaware have exclusive jurisdiction, and both parties consent to those courts, except where applicable law requires otherwise.

Changes to these Terms

We may update these Terms. We will post the revised version and update the date, and give additional notice or obtain affirmative acceptance where required by law. Unless applicable law requires otherwise, continued use after an update takes effect means you accept it. Changes do not override the Mac app's open-source licence or remove rights the law protects.
